Rules and claiming your winnings
Facebook and Instagram competition terms and conditions

Preamble

The competition statutes are the only binding document that regulates the competition’s detailed rules so that the competition’s terms and conditions are precisely and comprehensibly defined.

I. Competition promoter

(from now on referred to as the “Advertiser”)

II. Competition time

The deadline for the competition is set for one week from the date of the announcement of the competition.

The announcement of the winner of the competition will take place on the seventh day, i.e., the last day of the competition, by drawing the winner from the comments on the individual social networks (FB, IG).

III. Participants of the competition

Any person residing in Slovakia (from now on referred to as “Contestant” or “Contestant”) who is at least 18 years of age and who meets the conditions of the Contest according to the strictly defined rules set out in the current Contest entry may participate in the Contest.

All those who meet these conditions will automatically be included in the selection. There will be two winners; one will be drawn on Facebook and one on Instagram.

IV. Competition rules

Usually, the conditions are as follows: for FB – to “like” our page, to “like” the contest photo, to share it on your board and to tag a friend; for IG – to follow our account, to “like” the contest photo and to tag two friends in a comment.

All those who meet these conditions will automatically be included in the selection. There will be two winners; one will be drawn on Facebook, and one on Instagram. If they do not claim their prize, new winners will be drawn.

V. Competition wins

The competition winner wins a non-cash prize, as stated in the competition entry. The prize is valid for one person, in one name only, and cannot be transferred to any other person. You can change the conditions by individual agreement by calling 0948 709 710.

VI. Communicating the results of the competition

1. The winner of the competition will be announced on the closing date of the competition. The winner of the competition will be notified of the terms and conditions by video draw and invited to contact us by message to verify their winnings. (As a business on FB, we cannot contact individuals).

2. We will notify the Winner of the value of the prize by § eight par. 10 of Act No. 595/2003 Coll. on income tax, as amended.

3. A prize in kind is subject to income tax and is considered other income within the meaning of Art. 1 lit. (j) of Act No. 595/2003 Coll. on income tax, as amended.

4. A non-cash prize not exceeding € 350 is a prize in cash within the meaning of Art. 2 lit. (m) of Act No. 595/2003 Coll. on income tax, as amended, exempt from income tax.

5. We have the right not to return the prize to the Winner if the Winner has failed to comply with or violated any of this Statute’s provisions.

VII. Consent to disclosure of data

In the event of winning the prize, the participant at this moment gives his/her consent within the meaning of Act no. 122/2013 Z.z. on the protection of personal data with the processing of personal data in the range of first name and surname to publish information about the prize on the Facebook page and Instagram in the field of the first name, surname, email, and phone number for the purpose of claiming the prize.

Consent is granted for the duration of the contractual relationship with MAXPLAZA. Consent under this Article may be withdrawn by written notice delivered to the Promoter.

VIII. The right of the Promoter to change the status of the competition or to cancel the competition

1. The Promoter reserves the right to change the status of the competition and the right to cancel the competition.

2. In order to effectively change the status of the competition or to withdraw the competition, the Promoter is required to publish this information about the change or withdrawal by notifying on the Facebook page or Instagram.

IX. Final provisions

1. This Statute shall enter into force vis-à-vis third parties on the date of the public announcement of the competition. Until that time, the Promoter may unilaterally amend individual provisions of the Statute without observing the conditions set out in Article VI. of this Statute.

2. The prize/prize from this competition cannot be claimed in court.

3. Persons participating in the competition express their unconditional consent to be bound by the Statutes.

4. In the event of any conflict between the provisions of the Statutes and the Promotional Materials relating to the Competition, or in the event of any ambiguity as to the interpretation of these Statutes or the Promotional Materials, the relevant provisions of these Statutes shall apply.

5. In the event of any disputes arising out of or in connection with this Competition, the individual participants and the Promoter agree to resolve them by mutual negotiation and agreement.

6. Wherever competition is referred to in these Regulations, competitive play is meant and vice versa.
